Orphan's Court Dockets show that Benjamine died intstate, leaving a widow and six children. His son Joseph petitioned the court for settlement of his fathers's estate, naming in addition to his mother, himself and five other heirs: George, Benjamin, Peter, Rachael who intermarried with George Sipes, and Sarah intermarried with her cousin James Cornelius, son of Joshua. Peter was confined in the Penitentiary at Philadelphia, Benjamin Jr had removed to KY. .On 24 Nov 1837 the court awarded an inquest of real estae.

From Baltimore Co, MD Families by Barnes where we find a Joseph Cornelius and his wife Elizabeth conveying to Thomas Stockdale, one half of the Tract Curgafurgis in May 1741; on May 1744 , Joseph Cornelius, a carpenter, conveys 100 acres of the same tract to Robert Cross. Assuming he was age 21 when he signed first agreemant Joseph would have been born on or before 1720.

Joseph Cornelius lived at Sipstown, Mill Creek, and Altoona, PA.

Alvah Chilcoat later swore to his own signature and to the fact that he saw Benjamin Cornelius sign the agreement in the presence of Joseph Cornelius. This was sworn in open Court on 23 November 1837, before John Reed, Clerk of Court. It was decreed that the contract be carried into full effect by the payment schedule specified. Recorded 23 November 1837. Record BK A-2, p. 67.1
